Privacy Policy

Vacanti Enterprises LLC, doing business as Smarter Plan ("we," "us," or "our"), operates smarter-plan.com for U.S. businesses. This policy covers our public website, inquiries, booking, communications, and partner applications. A client's use of its own customer information through our services may also be governed by the client's notices and applicable service or data-processing agreements.

1. Information and purposes

We collect information you submit, such as name, business, email, phone number, inquiry content, qualification answers, appointment details, partner application details, and communication choices. We use it to respond, assess fit, arrange appointments, process applications, provide requested services, record consent, and administer business relationships. Billing or project information may be handled separately when you purchase services; entering our public forms does not authorize payment.

Hosting and security providers may process IP addresses, browser/device information, request times, and security logs to operate and protect the site. Requested phone verification uses temporary challenge records and rate limits. With advertising permission, we collect campaign parameters, click and browser identifiers, page visits, and booking events to measure marketing.

2. Necessary storage and advertising choices

Necessary cookies and session storage support booking, verification, security, and the steps you request. Advertising tracking is off until you choose Accept advertising in our privacy banner. Reject advertising leaves necessary features available. Use Privacy choices at any time to change your choice. Your choice is specific to this browser/device and is remembered for up to 180 days; clearing browser storage may reset it.

We treat Global Privacy Control as a rejection of advertising tracking. When it is on, advertising cannot be enabled through our banner. Rejecting advertising stops our Meta and campaign tracking and clears our stored campaign attribution and accessible Meta advertising cookies. It does not recall information already sent before rejection or delete CRM business records. Browser settings can also clear cookies and local/session storage.

3. Providers and disclosures

We use GoHighLevel for contacts, inquiries, consent records, calendars, conversations, and configured workflows; Vercel for hosting; Signal House for requested verification texts; and Upstash for temporary verification and rate-limit storage. With advertising permission, our website sends Meta advertising identifiers and visit or booking events. We do not include phone numbers, email addresses, SMS choices, or form contents in those website events. Third-party embedded video players may also process information under their own policies when loaded or used. We may use contracted support, professional, communications, and payment providers as needed for the services you request.

We may disclose relevant information to providers supporting those purposes, as required by law or valid legal process, to protect rights and security, with your direction, or in a business transaction subject to applicable privacy obligations. We do not sell personal information for money. Advertising disclosures may constitute sharing or targeted advertising under applicable state law; our advertising choices apply regardless of whether a particular statutory threshold is met.

Mobile phone information and SMS opt-in data or consent are not provided to third parties or affiliates for their own marketing or promotional purposes. Contracted providers may process this information to deliver and support our communications. General disclosure language in this policy does not authorize sharing SMS consent for others' marketing.

4. Texts, calls, and email

Requesting a verification code requests that verification text, not promotional messaging. Our forms separately offer optional non-marketing and promotional text choices. We record the submitted choices, notice version and wording, source, and receipt time with the contact. An unchecked choice is not an opt-in. Submitting a phone number or verifying it is not permission for unrelated marketing calls.

Message frequency varies; message and data rates may apply. Reply STOP to opt out of SMS and HELP for help, or email nick@vacantienterprises.com. Marketing consent is not a condition of purchase. We honor applicable revocations and provider suppression. Necessary account or legal information may be communicated through other permitted channels; a service-related purpose does not override an applicable SMS opt-out. You may ask us to stop marketing email using its unsubscribe method or our contact email.

5. Retention and security

Campaign attribution stored by this website expires after 90 days from capture and is cleared when advertising is rejected. Our booking cookie lasts up to seven days and can be renewed during booking activity. Verification challenge and verified-state records have short expirations, generally 10 and 20 minutes; security counters and provider delivery records have separate lifetimes. These expirations do not mean CRM records or provider logs are deleted on the same schedule.

We keep inquiry, application, consent, service, and business records as reasonably necessary for their purposes, support, legal obligations, dispute resolution, and documenting choices. Retention depends on record type and applicable requirements. You may request deletion, subject to permitted or required retention. We use reasonable safeguards; no storage or transmission method is completely secure.

6. Requests and rights

Email nick@vacantienterprises.com to request access, correction, deletion, limits on use, or assistance with your choices. Depending on applicable law, you may have portability, advertising opt-out, or appeal rights. To appeal a decision, reply to our decision email describing your request. We may verify identity where appropriate for access or deletion; browser advertising choices do not require an account or identity verification. We do not discriminate for exercising applicable rights. To stop future browser advertising tracking, use Privacy choices or Global Privacy Control; an email request does not itself change another device's browser settings.

7. Children and third-party links

The site is intended for adult business users, not children under 13. We do not knowingly collect information from children under 13. Contact us if you believe a child has provided information. External sites and embedded video providers have their own privacy practices.
